By accessing our website, scheduling consultations, or using our services, you agree to abide by these Terms. If you do not agree, please refrain from using our services.

1. Definitions

  • "Client" refers to any individual, company, or organization that engages with JIMTECH for services.

  • "Services" include but are not limited to consultations, strategy sessions, JIMTECH Essentials (JTE), JIMTECH Core (JTC), JIMTECH Elite (JTX) packages, ongoing retainer packages, training programs, and advisory support.

  • "Website" refers to https://JIMTECHConsulting.com.

  • "Policy Review" refers to cybersecurity policy guidance, compliance alignment, training, and risk identification based on NSA IAM (Information Assurance Methodology) best practices and frameworks.

2. Scope of Services

2.1 Consultation Services

  • Free Discovery Call: A brief session (15–30 minutes) to understand client needs and determine fit.

  • 60-Minute Strategy Session: Tailored advisory consultation addressing immediate needs.

  • Premium Consultation: A comprehensive strategy session ranging from 90–120 minutes for in-depth analysis and guidance.

2.2 Technology & Cybersecurity Policy Reviews (JTE, JTC, JTX)

  • In-depth policy reviews and compliance alignment assessments based on NSA IAM methodologies.

  • Identification of vulnerabilities in current technology and cybersecurity policies.

  • Actionable recommendations for improving policy frameworks, staff training, and adherence to compliance standards.

  • Employee training on cybersecurity best practices and protocols.

2.3 Ongoing Support Retainers

  • Monthly subscription for ongoing policy reviews, compliance guidance, training, and risk management.

  • Regular policy updates to align with changing industry standards and regulations.

  • Custom-built roadmaps and quarterly performance reviews.

2.4 Training and Workshops

  • Employee training on cybersecurity policies and best practices.

  • Interactive workshops tailored to specific business needs and compliance requirements.

3. Client Responsibilities

  • Provide accurate, up-to-date information during onboarding and consultations.

  • Ensure timely access to necessary resources, tools, and information required for service delivery.

  • Comply with national and international cybersecurity policies, regulations, and best practices.

  • Respect the intellectual property rights of JIMTECH, including proprietary processes and methodologies.

4. Payment Terms

4.1 Pricing and Fees

  • Consultation fees and service package prices are outlined on our website and booking system.

  • Custom pricing applies to JTE, JTC, and JTX packages based on scope, size, and complexity.

4.2 Payment Methods

  • Payments are processed securely through our online booking system (e.g., Stripe, PayPal).

  • Invoices for custom services must be paid within 14 days of receipt unless otherwise agreed upon.

4.3 Late Payments

  • Late payments may incur a fee of 1.5% per month or the highest rate allowed by law.

  • Failure to pay outstanding invoices may result in service suspension or termination.

4.4 Refund Policy

  • No refunds will be issued for completed consultations or services.

  • Refunds for pre-paid services will follow the guidelines outlined in custom proposals.

5. Cancellation and Rescheduling Policy

  • Appointments may be rescheduled or canceled up to 24 hours before the scheduled time without penalty.

  • Cancellations made less than 24 hours before an appointment will incur a 50% service fee.

  • No-shows will be charged the full consultation fee.

  • In case of emergencies, clients may contact us directly for special consideration.

6. Confidentiality

  • JIMTECH will maintain strict confidentiality of all client information, data, and discussions.

  • No client information will be shared with third parties without explicit written consent, except where required by law.

  • Clients must also respect JIMTECH's proprietary methodologies, training materials, and intellectual property.

7. Intellectual Property

  • All reports, roadmaps, training materials, and strategic guidance provided by JIMTECH are our intellectual property.

  • Clients are granted a limited, non-transferable license to use the materials for their internal business purposes only.

  • Reproduction, distribution, or public sharing of JIMTECH materials without prior written consent is strictly prohibited.

8. Limitation of Liability

  • JIMTECH provides services based on best practices, industry standards, and expertise. However, we cannot guarantee specific results.

  • Under no circumstances shall JIMTECH, its employees, or affiliates be liable for indirect, incidental, or consequential damages arising from service use.

  • Maximum liability shall not exceed the amount paid by the client for the specific service rendered.

9. Data Privacy and Security

  • JIMTECH adheres to applicable data protection laws, including GDPR, CCPA, and Virginia CDPA.

  • Data collected is used only for service delivery, billing, and communication purposes.

  • Clients can review our Privacy Policy for detailed information on data usage and protection.

10. Governing Law

These Terms of Service are governed by and construed under the laws of the Commonwealth of Virginia, USA, without regard to conflict of law principles.

10.1 Dispute Resolution

  • Any disputes shall first be attempted to be resolved through good-faith negotiations.

  • If unresolved, disputes shall be submitted to binding arbitration in Virginia, in accordance with the American Arbitration Association (AAA) rules.

11. Termination of Services

  • JIMTECH reserves the right to terminate or suspend services if a client breaches these Terms.

  • Clients may terminate ongoing services with a 30-day written notice.

  • Upon termination, clients are responsible for any outstanding fees or costs incurred.

12. Force Majeure

JIMTECH shall not be held liable for any delay or failure in performance caused by events beyond our control, including natural disasters, cyberattacks, power outages, or government restrictions.

13. Updates to Terms of Service

JIMTECH reserves the right to update or modify these Terms at any time. Updated Terms will be posted on our website with an updated "Last Updated" date.
